These Terms of Service ("Terms") govern your access to and use of the Crystl Ground website and any related services (collectively, the "Service") operated by Crystl Ground Group ("Crystl Ground", "we", "us", or "our").
By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the Service.
1. Eligibility
You may use the Service only if you are at least the age of majority in your jurisdiction and are legally capable of forming a binding contract, and only in compliance with these Terms and all applicable laws.
2. Use of the Service
When using the Service, you agree that you will not:
- Use the Service for any unlawful purpose or in violation of any applicable law or regulation.
- Attempt to gain unauthorized access to any portion of the Service, other systems, or networks.
- Interfere with or disrupt the integrity or performance of the Service.
- Use any automated means (including bots, scrapers, or spiders) to access the Service without our permission.
3. Artist Relationships & Submissions
Any music, artwork, demos, or other materials you submit to us (collectively, "Submissions") remain your property unless otherwise agreed in a separate written agreement. By sending Submissions, you represent that you have the necessary rights to do so and that your Submissions do not infringe the rights of any third party.
Any specific terms covering releases, revenue splits, and rights management will be set out in separate agreements between you and Crystl Ground and will take precedence over these general Terms where they conflict.
Revenue Splits: Our standard revenue share model allocates 85% of net royalties to the artist and 15% to Crystl Ground, unless a different rate is specified in your individual distribution agreement.
4. Intellectual Property
Except for content that you own or license to us under a separate agreement, all content on the Service (including text, graphics, logos, and layout) is owned by or licensed to Crystl Ground and is protected by copyright and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the Service without our prior written consent.
5. Third-Party Services & Links
The Service may contain links to third-party websites or services, including music platforms such as Spotify or other DSPs. These third-party services are not controlled by us, and we are not responsible for their content, policies, or practices. Your use of any third-party service is at your own risk and subject to the terms of that third party.
6. Disclaimer of Warranties
The Service is provided on an "AS IS" and "AS AVAILABLE" basis. To the fullest extent permitted by law, we disclaim all warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
7. Limitation of Liability
To the maximum extent permitted by law, Crystl Ground and its directors, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, arising out of or related to your use of, or inability to use, the Service.
8. Changes to the Service and Terms
We may update or modify the Service at any time without prior notice. We may also update these Terms from time to time. When we do, we will revise the "Last updated" date at the top of this page. Your continued use of the Service after any changes to the Terms constitutes your acceptance of the revised Terms.
9. Governing Law
These Terms and any dispute arising out of or relating to them or the Service will be governed by and construed in accordance with the laws applicable in your jurisdiction, without regard to its conflict of law principles.
